DEVELOPMENT AND
COMPENSATION
Development
takes Place, only because of the Workers and Thinkers. If the two are not there, there is No
Development, Break Through, or Progress.
And, there is No Question of Crossing the
Barriers of Knowledge, Limitations of Thinking and Hurdles of Development. Without them, there can not
be Wealth, Riches, Money, Capital, Creations, Banks, Investment and
Development. Yet, both Workers and
Thinkers are invariably cheated, disappointed, and end up as big failures, or
even become Slaves of the State and Society!
That is the sad end, and had always been so; unfair unjust and
unreasonable over all these recent long millenniums.
Whenever
Land is Acquired by anyone, for any Development, Compensation should not be
limited to just the Cost of the Land, or big Buildings and the huge
Infrastructures there in. Compensation
for Utility and Usage, in short Social Compensation must be
paid for the Life and Livelihood Disturbed and Dislocated. That should take into consideration the
importance and need for the homes, land for food livelihood and work. Hence, there should be
Livelihood Compensation, for their living places, homes such as the huts and
thatched cowsheds, or wells and pump-sheds, as well as the plants and trees,
like the commonly and popularly useful drumstick trees, banana plants, berry
shrubs etc, that are socially useful and beneficial for those disturbed
families, but otherwise don’t have any useful purposes for others than the poor
weaker sections, hence no economic monetary values are attached to them by the
govt officials, business and private agencies, other than their poor owners.
Compensation
for any Land acquired, should also have some important Provisions, for Future
Instalment Payments, taking into account all the Recurring Returns, from the
lands. Yes, the raising value of the land, and price
escalations over the years have to be taken into account, and considerations
have to be paid at periodic intervals of, say every four or five years. That must be somewhat the same, like the
Interests accruing and payable on Savings Bank Accounts, and Fixed Deposits of
the Moneys, parked with the Banks and other Financial Institutions.
Present
Models of Development, invariably starts with the Destruction of Nature,
Dislocation of Societies, Displacements of People, and Marginalisation of the
Poor. Today, things have gone too very far, that
when we were all actually fearing, both the Pace and Processes of Development,
and waiting for Wars on Water, we are now suddenly faced with the reality of
inevitable Battles Fights and Wars for Food.
When we
are now faced, with the multiple cascading and in fact the multiplying grim
Realities of No Food and No Water, and Wars over it, what use is the use and
importance of the present Land Acquisitions for further Developments, in the
existing Models and Practices of Land Usage?
When we are Faced
with Shortages, and hence Agitations Fights and Wars over Food and Water, will
any of those small big and faster Cars, we proudly talk about help anyone to
run and drive out to really escape from the calamities and consequences of the
looming Wars over Food and Water?
In view of the above,
there is No Meaning in Developments in or of the Nation, when they are made in
the Name of the Nation, for the whole Society and all People, but when actually
near 99% of the People are not actually kept in mind, but are casually and
easily neglected, and are alienated in fact from all allocations of Work Water
Land Food Economy Developments and Benefits.
So, Please Don’t just Develop anytime, a Place or things or men and women,
but always think of Developing the Quality of Life of People, Communities as a
whole, and the Society, as well as the Contents and Extent of Education, and
also the Quality and Purposes of Education.
When
Compensation and Developments, as well as the Benefits of Developments are
Rights, we must have them. And, when there is a Right, there has to be a Remedy! When there has to be a Remedy, that has to be
some Legal Remedies. Hence,
the need for Statutory and or Constitutional Provisions to Protect the People,
the present majority, who are the silent suffering ones.
If we
want to have a Legal Remedy, there has to be a Legal System, to Provide all those Legal Remedies! If Legal System has to be effective, there
has to be some really Good Courts, and Powerful Enlightened Jurists and
Judges. Sadly
here are the Problems in the Country these days.
We have
either traditionally weak Courts and Pliable Judges, inaccessible Courts,
Arrogant and Intolerant stupid prejudiced biased corrupt caste oriented Judges. And we have Judges
who look beyond the Courts, with lots of keen personal interests, about their
lives and statuses, much after their terms.
Nearly
for a Century, we have been forced to suffer all the brahmanic dominations, in almost all our Courts,
right from and even during the British Times.
They always delivered only considered brahmanic judgements, influenced by big brahmanical needs, thoughts, prescriptions and
philosophies. Hence, all the Judgements were invariably based on biased conclusions and prejudiced
decisions. That all, to protect every
one of the cast hindu
values, and uphold their brahmanic hindu interests.
These had resulted in lack of evolution and growth of Legal Acumen, and
Laws for the Good of the People and Society, particularly the Weaker Sections
of the Country, like SC&ST Dalits, MBCs, Minorities, Working Classes and Women.
The only Exceptions, where the Courts appear to stand
up and speak loudly, are at those times and in the cases of brahmanic
officials, seeking retention of their undue advantages over others or against
the Govts, and in favour of brahmanic men first, and then women against others and
workers, or where the cases do not affect the brahmins,
brahmin values, brahmin
interests and brahmin communities. These are definitely bad, and very sad, to
even think about at anytime, or talk. And in fact, many SC&ST Dalits
BCs and Minorities themselves may not like.
