Hands of Fundamental Fascist Forces

 

The Dalit Centre on Constitution Law and Jurisprudence, had jointly with the Ambedkar Centre to Prevent Racial Communal and Caste Violences, considered all the available information and detail of the recent painful events of the ongoing Terrorism, Violence, Communal Strife and Bomb Blasts.  It had sadly found that, almost everyone starting with the fundamental fascist forces and the Police, Bureaucracy, TV, Newspapers, other Print Media etc, relate them directly or indirectly to contentious debatable hindu mob, and their electoral Interests and Issues like Cow Slaughter, Religious Conversion.

 

It is considered, after deep study and reflection that, the hands of the fast emerging fundamental fascist forces could be seen everywhere.  They are there in every one of the sad incidents.  They are out to deliberately malign the Muslims for Terrorism, Violence and Bomb-Blasts.  And they as well try to justify direct attack on the Christians and Muslims separately, taking them one by one, and at separate times in different areas.  That, as if the attacks could be justifiable, and the fundamental fascist forces have a right to attack others, that too in a criminal way and in cruel manners.

 

The fundamental fascist forces, want to brand themselves as Nationalists, to get away from their Criminal Responsibilities, and the Law and Order Machineries.  That, as if they are all spontaneous uncontrollable sentimental religious mob furies.  If it is so, the concerned religion, causing all those mob furies must be banned, and its activities restricted or rightly regulated in a very strict way; and the leaders directly and speedily prosecuted, and quickly punished.

 

The Mob Fury is –

 

  1. to justify attack on minorities,
  2. terrorise the Christians and Muslims,
  3. consolidate the Vote Banks of the mobs of backwards, criminalised lumpen STs, threatened coerced brainwashed and attacked SCs to win the elections and form the Govts, and
  4. also Force the Christians and Muslims to Vote for the fundamental fascist forces to buy peace protection safety security and some protection under the future Rule of the emerging fundamental fascist forces.

 

It is also for –

 

  1. gaining absolute Control of the Economy – the Manufacturing and Retail Business,
  2. takeover all land in some form or the other with one or other excuse and justification,
  3. control education employment jobs and wages,
  4. completely monopolise bureaucracy police courts and media,
  5. determine the destiny and future of the people and all communities,
  6. enslave for ever STs, SCs, BCs, and every group of Minorities in Country,
  7. take over the entire political interests in most States and whole of the Country,

 

The Evil Efforts of the fundamental fascist forces appear at present to be silently strongly and actively supported by many of the ruling National Parties and feudal caste based Regional Parties.  Hence we can not silently expect the Media, Press, Courts, Police, Bureaucracy, State Govts or the Govts at the Centre now or in future really do anything in the Interest of People, Law and Order, Democracy and Secularism.

 

The Country, its Ruling Elites, and Political Parties never have been believing in –

 

  1. Justice,
  2. Equality,
  3. Freedom,
  4. Secularism,
  5. Democracy,
  6. Independence,
  7. Rule of Law, and
  8. Crime and Punishment,

 

Taking into consideration all the above, and the increasingly arrogant flexing of muscles, open show of Communal Violence by the fundamental fascist forces, our Intellectuals in the Dalit Centre on Constitution Law and Jurisprudence, had jointly with the Ambedkar Centre to Prevent Racial Communal and Caste Violences, feel that the time has come to Frame a Communal Violence Code on the lines of CPC and CrPC.  Since the interests of the fundamental fascist forces revolves around Economic, Education Employment Land and Political Power, the Jurisprudence of Communal Violences have to evolve around and be based on these Specific Interests of the fundamental fascist forces of the feudal elements still alive and active in the Country.  We welcome all Contributions and Constructive Positive Suggestions in this Regard.  Meanwhile, some Attempts have been made to Codify specific Violences and Attacks, and the appropriate Punishments for the same.  These could be openly considered and debated by all concerned, to lobby and force all Leaders, Political Parties and Govts to adopt and enact them immediately into a Law on CVC at the earliest, to save the Country, its Constitution and fragile tottering Democracy.

 

We must Identify all Types of Atrocities Attacks Crimes Desecration Denigration, indecent-Acts Violences.  They should be included in the Communal Violence Code or CVC, and the Proportionate Punishments and Penalties that must be awarded in consonance to the Criminal Act, under CVC.

 

1.      Mob Attacks on –

 

a)      SCs, STs, MBCs, BCs, OBCs, Minorities particularly Buddhists christens Muslims and Sikhs,

b)      Ambedkar Statues, and Damage Destruction Removal and Breakage of them, and disrespect shown to Dr Ambedkar’s Portraits Photographs Names and Works,

c)      Buddhist Monks, Buddhist Nuns, Buddhists, Buddh-Viharas, Buddha Statues Portraits and Pictures,

d)      Christian Pastors, Priests, Brothers, Sisters, Mothers, Nuns, Churches, Christ, Cross, Bible, Infant Jesus, Mother Mary, Father Joseph,

e)      Holy Koran, Maulvis, Muslims, Madrasas, Mosques, Durgah,

f)        Gurudhwaras, Granths,

g)      Minorities, their Homes, Properties, Produce, Harvest, Crops, Cattle, Wells, Water-bodies,

 

2.      Delay by the Police in Registering the FIRs about any Mob Attack, and taking cognisance of Group Violences, Communal Atrocities, Caste Attacks,

 

3.      Failure to visit the spots of the Attack and Atrocities,

 

4.      Reluctance, Delayed Action Hesitancy and showing Unwillingness in taking immediate action against the perpetrators of the Attacks; those leading the   

            Attacks and the Mob, and those encouraging the attacks and attackers, as well as the Organisers.

 

Every hour of Delay in Registering FIRs, or in Taking Action should immediately be punished by withholding their Increments by one Month.

 

Delay and Inaction by a Day, should Reduce their Seniority by one Recruitment and Promotion Year.

 

Police present at the Spot and Place of the Crime, and had failed to Stop the Attack and Crime must be sacked immediately.

 

All Gang Leaders of the Attackers must be Arrested, and their personal Properties, and all Assets of their Organisations must be ceased and utilised for the Rehabilitation of the Victims and Survivors of the Families of the Victims,

 

A minimum of Ten Percent of the Earnings of the People in the Area, must be taken as a levy and penalty to rehabilitate the Victims of the Mob Attacks, and to help the Survivors of the Families of the Victims,

 

At least 25% of the Grains and Food Items in Stock from all houses and shops, as well as the Standing Crops in the Fields, and the Harvest during the Year from the Area must be taken over to feed the Victims and Survivors of the Families of the Victims.

 

The Land Holdings of ever Big Farmer, in excess of 25 Acres must all be taken over, to rehabilitate the Victims and Survivors of the Families of the Victims, for Building Homes and Distribution for Cultivation and Survival with Dignity of the Victims and Survivors of the Families of the Victims.

 

Some other specific Provisions for the Draft Communal Violence Code, are included, in the Annexure enclosed herewith.  These could be added upon and also debated appropriately in detail.
